7. Processing of personal information
MUFK Integrated may process personal information about website visitors, enquirers, client and supplier contacts, authorised platform users, employees, contractors, service providers and other persons connected with its services and operations.
Information may be processed to respond to enquiries, arrange demonstrations, provide and support services, administer business relationships, maintain records, secure systems, comply with legal duties, manage employees and contractors, and communicate where permitted.
Relevant information may be supplied to authorised personnel, clients responsible for configured workspaces, approved operators and service providers, professional advisers, regulators, law-enforcement authorities or other recipients where authorised or required. Cross-border processing, where applicable, is subject to the safeguards required by POPIA.
Reasonable technical and organisational measures are used to protect personal information, taking account of the nature of the information and the relevant risks. More detail is available in our Privacy Notice and Security and Data Handling overview.
8. How to request access to a record
- Confirm that PAIA is the appropriate route.
A PAIA request seeks an existing recorded record. It is not a process for general questions, legal advice, discovery in litigation, or routine support. If you seek your own personal information, the Information Officer may guide you on the appropriate POPIA or PAIA route. - Complete the prescribed Form 2.
Use the current Request for Access to Record form. - Identify the record and the relevant right.
Describe the record clearly, provide any reference number, identify the right you seek to exercise or protect, and explain why the record is required for that purpose. - Attach supporting proof.
Include appropriate proof of identity. If acting for another person or entity, include proof of authority. You may redact information not reasonably needed for verification. - Select the preferred form of access.
State whether you seek inspection, an electronic copy, a printed copy or another available form, and identify any accessibility needs. - Submit the request.
Email the signed form and attachments to admin@mufk85.co.za with the subject “PAIA request”, or deliver it to the physical address in section 2.
Do not submit passwords, one-time codes or unrelated sensitive information. We may contact you if the record, right, authority or preferred access method needs clarification.
9. Fees, deposits and response times
A requester other than a personal requester may be required to pay the prescribed private-body request fee before the request is processed further. If access is granted, prescribed reproduction, search, preparation, media, delivery or other access fees may also apply.
If preparation of the record is expected to exceed the period prescribed by the PAIA Regulations, a deposit may be required. We will provide written notice of applicable fees, deposits and payment details. Fees are governed by the current official schedule, which may change.
View the Information Regulator’s current PAIA fee structure.
We will ordinarily decide a properly submitted request within 30 days. PAIA permits the response period to be extended once by up to a further 30 days in specified circumstances. If extended, we will notify the requester and explain the reason.
Our decision will state whether access is granted, partially granted or refused, any fees payable, and the applicable remedy. Access will be provided in the requested form where reasonably possible and lawful.
10. Grounds on which access may be refused
Access is not automatic. PAIA requires or permits refusal in certain circumstances, including where disclosure would:
- unreasonably reveal personal information about a third party;
- reveal protected commercial, financial, technical or confidential information of MUFK Integrated or a third party;
- breach a duty of confidence owed to a third party;
- endanger a person’s life or physical safety or prejudice security measures;
- disclose a record privileged from production in legal proceedings;
- prejudice research information protected by PAIA; or
- otherwise fall within a mandatory or discretionary ground for refusal under PAIA.
Where a protected part of a record can reasonably be separated from a disclosable part, access may be granted to the remainder. A refusal will identify the applicable PAIA basis and available remedy, unless PAIA lawfully restricts the detail that may be given.
11. Complaints and other remedies
PAIA does not require an internal appeal process for a private body. If a request is refused, only partly granted, not answered within the applicable period, or disputed regarding fees, form of access or another PAIA issue, the requester may lodge a complaint with the Information Regulator or approach a competent court, subject to PAIA’s procedures and time limits.
The Information Regulator states that a complaint concerning a private body should generally be lodged on Form 5 within 180 days of the refusal, non-response or other decision complained of. The requester should first give the private body an opportunity to respond and should attach the original Form 2, the response and relevant correspondence.
